PURCHASER AGREES TO THE FOLLOWING CONDITIONS OF SALE:
1) Adequate indoor facilities will be provided, and this kitten will not be allowed to roam outdoors. Purchaser will provide routine veterinary care as needed, which the purchaser is solely responsible for. This kitten will not be declawed. Declawing is mutilation and can cause severe behavioral problems. _________
2) Deposit paid goes towards the total price of kitten and is non refundable and non-transferable, unless the sale is canceled by the seller. I reserve the right to cancel a sale at any time if I feel it is not in the best interest of the kitten. No kitten will be held or reserved without a deposit placed. Deposits are non transferable, if you cancel the purchase of a kitten, you may not transfer your deposit to a different kitten. Kitten must be paid in full by pick up time which is 12 weeks of age. If you ask that you pick your Kitten up at a later date for whatever reason, the Kitten will still be paid for in full by 12 weeks of age. We cannot board kittens past the go home date that have not been fully paid for. Please confirm pickup date with breeder or if paying for shipping, airline ticket purchased confirmation will be sent to buyer. __________
3) Buyer is responsible for all fees associated with shipping the kitten via Flight Nanny if that is the desired route of delivery. If the kitten is to fly out, the kitten must be paid for in full at least one week before the date of delivery/flight via Zelle, bank wire/deposit, Apple Cash. The buyer will pay Flight nanny directly for his/her service prior to flight via Venmo, Zelle. Breeder will provide a brand new airline approved carrier for kittens flying out only. If you are picking your kitten up from our home you must bring a carrier for pickup. Please be sure to bring cash for the balance when you are picking your kitten up in person. __________
4) If kitten/cat is being purchased as a pet (limited CFA pet registration without breeding rights), kitten is to be neutered or spayed by 9 months of age or within 30 days of purchasing an adult cat, and is not to be used for breeding under any circumstances. If proof of spay/ neuter is not provided by nine months of age, the breeder is under the assumption that this kitten is being used for breeding and you will be expected to pay a violation of breeding rights fee of $1,000. ___________
5) Purchaser agrees to keep the kitten/cat isolated from other animals in the home until inspected by a licensed vet. If the kitten is exposed to other pets in the home before being examined, the health guarantee is null and void. _________
6) Health guarantee: To the best of my knowledge, purchaser is receiving a healthy cat/kitten free from infectious disease or life threatening congenital defects. This kitten is guaranteed to be free of Felv/FIV at the time of purchase, and guaranteed to be PKD negative. To validate health guarantee, the purchaser must have kitten examined by a licensed veterinarian within 3 days of pickup. If any serious or life threatening illness or defect is found by the veterinarian within the 3 day time frame, the kitten may be returned to seller for a replacement kitten. Breeder cannot guarantee against future illness or injury that may incur once leaving my care. The breeder cannot guarantee lifetime health of the kitten or cat. If the kitten is not examined by a licensed vet within the 3 day time frame stated to confirm health, the health guarantee is null and void.
The purchaser must activate the FREE 30 days health insurance by Trupanion. The purchaser will be responsible for any traveling/shipping costs associated with returning the kitten/cat to the breeder. Seller agrees to replace the kitten if it dies from a life threatening congenital defect within the life of the cat. The seller must be provided a written statement from a licensed vet stating that the kitten has died from a congenital defect. The breeder would then replace the kitten with a similar quality kitten when one becomes available. No refund will be given. The buyer is responsible for any delivery/traveling costs associated with getting a replacement kitten. The breeder is not responsible for any medical bills. __________
7.) The seller is not responsible for any veterinarian expenses incurred at any time once the kitten has left my care. Please understand the risk with purchasing a live animal. Even the healthiest of animals can and will get sick if exposed to certain viruses and microbes. The breeder is absolutely not responsible for any medical bills or other repercussions resulting from injury or infectious illnesses. These include but are not limited to: Feline Herpes Virus, Calicivirus, Panleukopenia, Feline Coronavirus (including the mutated FIP), Chlamydia, 4 way or other than recommended vaccine injury. Any routine, emergency, or unexpected medical bills is solely the responsibility of the buyer, and the buyer may NOT ask the breeder for reimbursement. If the kitten is given FELV vaccination or 4-way vaccine at any time, this health guarantee is null and void. This vaccine is associated with many risks including death, and also commonly causes false positives. Minor nuisances such as fleas, fungus, upper respiratory infection etc. are not serious conditions and are not grounds for return nor if you have other animals can the breeder be responsible for the conditions and exposure to other animals or the accidental escaped kitten and what your new kitten can pick up. These conditions are very common and easily treated. To the best of my knowledge this kitten/cat has NONE of these, and I will never knowingly place a kitten that exhibits even any of the minor conditions aforementioned and have been inspected and vaccinated by our veterinarian. All paperwork is transferred to the new buyer upon delivery._________
7) If the buyer is no longer able to care for this kitten/cat a suitable home must be found. Kitten or cat may not be placed in an animal shelter. _________
8) Please send a yearly photo update or as often as you like. We love receiving photos and watching these beautiful babies as they grow. I do my very best to send regular photo updates until your kitten is ready to leave, but due to our busy schedule between family, raising the kittens, and caring for our breeders, please expect photo updates every one-two weeks by video or pictures. They will be sent more often when our schedule allows.__________
9) I understand that this contract is legally binding and non negotiable. I understand that my digital/electronic signature on this contract is equivalent to my personal signature and is completely binding. This contract/agreement is executed in Humboldt County, California and is subjected to the laws of the State of California where any and all enforcement actions shall be executed.___________
